These Customer Account Terms & Conditions (“Terms”) apply to the creation and use of a GetPackt customer account and the submission of order requests through the GetPackt website.

By creating an account or submitting an order request, you agree to these Terms.

GetPackt is operated by The Trustee for NN Family Trust, ABN 59 460 075 246 (“GetPackt”, “we”, “us” or “our”).

1. Customer Accounts

Customer accounts are provided to assist customers in submitting order requests and managing their dealings with GetPackt.

You agree that information supplied when creating or maintaining an account will be accurate and reasonably current.

You must update your information if your business, contact or delivery details materially change.

GetPackt may approve, reject, suspend or close an account where reasonably necessary, including in cases of suspected fraud, security concerns, misuse, unpaid accounts or material breaches of these Terms.

2. Authorised Business Users

If you create or use an account on behalf of a company, partnership, trust, organisation or other business, you represent that you are authorised to do so on its behalf.

The customer is responsible for controlling which employees or representatives are authorised to access and use its GetPackt account.

Order requests submitted through an authorised customer account may be treated by GetPackt as having been submitted on behalf of that customer, subject to applicable law.

If an authorised user leaves your business or should no longer have access, you are responsible for promptly updating the account or notifying GetPackt.

3. Account Security

You are responsible for keeping your login credentials confidential and for taking reasonable steps to prevent unauthorised access to your account.

You must not knowingly:

  • share login credentials with unauthorised persons;
  • attempt to access another customer’s account;
  • interfere with the operation or security of the website;
  • upload malicious software or code; or
  • use the account for unlawful or fraudulent purposes.

Please notify GetPackt promptly if you suspect unauthorised access to your account.

4. Order Requests — Important

After receiving an order request, GetPackt may check matters including:

  • product availability;
  • quantities;
  • pricing;
  • delivery location;
  • delivery timing;
  • account status; and
  • other relevant supply requirements.

An order is accepted when GetPackt communicates acceptance or confirmation to the customer, or otherwise accepts the order in accordance with applicable law.

An automatically generated website message or email acknowledging receipt of an order request is confirmation that we received the request only and is not, by itself, confirmation that the requested products are available.

5. Product Availability

Products displayed on our website may not necessarily be available at the time an order request is submitted.

Stock levels can change without notice.

If an item is unavailable or insufficient quantities are available, GetPackt may contact you to discuss:

  • a reduced quantity;
  • an alternative product;
  • a later delivery;
  • back-ordering where available; or
  • removal of the unavailable item.

We will not substitute a materially different product without obtaining the customer’s agreement where agreement is reasonably required.

6. Product Information

We endeavour to keep product descriptions, dimensions, images, specifications and other information reasonably accurate.

Images may be illustrative, and packaging, colour, branding or appearance may vary where this does not materially change the product ordered.

Customers should confirm any specification that is critical to their intended use before ordering.

Nothing in these Terms excludes rights that cannot lawfully be excluded.

7. Pricing

Prices displayed on the website or otherwise communicated by GetPackt may be updated from time to time.

Unless expressly stated otherwise, the applicable price for an order will be the price confirmed by GetPackt when the order is accepted.

Where a displayed price is affected by an obvious error, system error or data-entry error, GetPackt may contact the customer before accepting the order to advise the correct price.

GST and delivery charges will be dealt with as stated on the relevant quotation, confirmation or invoice.

8. Delivery

Any delivery date or time communicated before final confirmation is an estimate unless GetPackt expressly agrees otherwise.

Delivery may be affected by stock availability, suppliers, transport providers, traffic, weather and circumstances outside our reasonable control.

GetPackt will endeavour to notify customers of material delays once we become aware of them.

Customers are responsible for providing accurate delivery details and reasonable access for delivery.

Additional costs reasonably incurred because incorrect delivery information was provided, or because delivery cannot be completed due to circumstances within the customer’s control, may be charged to the customer where permitted by law.

9. Checking Deliveries

Customers should inspect deliveries within a reasonable period after receipt and notify GetPackt promptly if:

  • products are missing;
  • incorrect products have been supplied;
  • goods appear damaged; or
  • quantities appear incorrect.

Prompt notification assists us in investigating the issue.

Nothing in this clause limits rights or remedies that cannot lawfully be limited.

10. Invoices and Payment

Invoices may be issued separately through Xero or another invoicing system used by GetPackt.

Payment terms will be those shown on the customer’s invoice, quotation, credit-account agreement or other written agreement with GetPackt.

Creating a website account does not automatically provide the customer with credit terms.

Any credit facility offered by GetPackt may be subject to a separate credit application and separate terms.

11. Cancellation or Changes to Order Requests

Before GetPackt accepts an order, customers should contact us promptly if they wish to amend or withdraw the request.

After an order has been accepted, cancellation or modification may be subject to our agreement, particularly where goods have already been ordered from a supplier, customised, allocated, dispatched or otherwise committed specifically for the customer.

Any cancellation fee or charge will only be imposed where permitted by law and reasonably reflects applicable costs or commitments.

12. Returns, Faulty Goods and Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded, restricted or modified, including applicable rights under the Australian Consumer Law.

Where the Australian Consumer Law applies, customers may have rights and remedies in relation to faulty, defective, damaged, incorrectly described or otherwise non-compliant goods.

GetPackt is not required to provide a refund or exchange merely because a customer changes their mind unless we have separately agreed to do so or applicable law requires it.

Please contact GetPackt promptly if there is an issue with supplied products so that we can assess and resolve the matter.

13. Customer-Specific or Special-Order Products

Products ordered, manufactured, printed, branded, sourced or customised specifically for a customer may not be cancellable or returnable merely because the customer changes their mind after the order has been accepted.

This does not affect any rights or remedies available under applicable law in relation to faulty or non-compliant goods.

14. Website Availability

We endeavour to keep our website and customer account facilities available and secure but cannot guarantee uninterrupted or error-free availability.

The website may occasionally be unavailable because of maintenance, updates, technical problems, internet outages or circumstances outside our reasonable control.

If the website is unavailable, customers may contact GetPackt using our other available ordering channels.

15. Liability

Nothing in these Terms excludes, restricts or modifies liability, rights or remedies that cannot lawfully be excluded, restricted or modified.

To the extent permitted by law, GetPackt will not be responsible for indirect or consequential loss arising solely from circumstances outside GetPackt’s reasonable control.

Any limitation of liability in these Terms applies only to the extent permitted by applicable law.

16. Privacy

Personal information associated with customer accounts and orders will be handled in accordance with the GetPackt Privacy Policy and applicable law.

By creating an account, you acknowledge that you have had the opportunity to review the GetPackt Privacy Policy.

17. Electronic Communications

You agree that GetPackt may use the email address and telephone number associated with your account to communicate with you about:

  • account administration;
  • order requests;
  • product availability;
  • deliveries;
  • invoices;
  • payment matters; and
  • customer service.

Consent to receive marketing communications will be dealt with separately where required.

18. Changes to These Terms

GetPackt may update these Terms from time to time where reasonably necessary, including because of changes to our business, website, products, processes or applicable law.

The current version will be available on our website.

Where a change materially affects an existing customer’s rights or obligations, we will take reasonable steps to provide appropriate notice where required.

19. Suspension or Closure of Accounts

GetPackt may suspend or close a customer account where reasonably necessary because of:

  • suspected fraudulent activity;
  • misuse of the website;
  • unauthorised access;
  • material or repeated breaches of these Terms;
  • overdue amounts;
  • security risks; or
  • discontinuation of the account service.

Account closure does not affect outstanding invoices, confirmed orders or rights and obligations that arose before closure.

Customers may request closure of their account by contacting GetPackt.

20. Governing Law

These Terms are governed by the laws applicable in Victoria, Australia.

Subject to any rights a party has to bring proceedings elsewhere under applicable law, the parties submit to the courts and tribunals having jurisdiction in Victoria.
